Family Medical Leave Act regulations are the basis for the federal 1993 Family and Medical Leave Act (FMLA). The regulations require compliance on the part of all parties concerned, including covered employers and qualified employees. Covered employers include, any U.S. employer who has 50 or more (full or part-time) employees within a 75-mile radius of their location, any public agency, including a federal, state, or local government agency, regardless of the number of employees, and public or private elementary or secondary schools, also regardless of the number of employees. All covered employers must comply with Family Medical Leave Act regulations.
Family Medical Leave Act regulations also apply to qualified employees. If an employee works for a covered employer, that employee “qualifies” for FMLA benefits if: the employee works at a location within 75 miles where the employer has at least 50 employees, has worked for the employer for at least 12 months (does not have to be continuous), and has logged at least 1,250 hours of service for the employer during the 12 month period immediately preceding the requested leave initiation date. Qualified employees must conform to all FMLA regulations.
