Big Changes to OFLA take effect beginning July 1st, 2024

A Comprehensive Leave Management System

This change is designed to minimize the overlap between the leave provisions of Oregon Family Leave Act (OFLA) and Paid Leave Oregon (PLO). The federal Family Medical Leave Act (FMLA) will remain unchanged.

Key Changes to OFLA (Effective July 1, 2024)

  • The qualifying events under the OFLA will be significantly reduced. OFLA will cover:
    • Home care for the employee’s child (both serious and non-serious health conditions) as well as school and childcare closure for public health emergencies
    • Bereavement
    • Pregnancy-related disabilities
    • From July 1, 2024 through January 1, 2025, OFLA will also provide up to two additional weeks of leave to facilitate the legal processes required for placement of a foster child or adoption (PLO will incorporate this leave beginning 2025).
  • OFLA will no longer run concurrent with Paid Leave Oregon (PLO). Eligible employees may choose from either OFLA or PLO (but not both) for qualifying events.
  • OFLA leave is capped at 12 weeks for home care of the employee’s child and bereavement. Bereavement leave is further limited to two weeks per family member with a maximum of four weeks in a given leave year.
  • OFLA provides up to 12-additional weeks for Pregnancy related disabilities.
  • OFLA will no longer contain special provisions regarding teachers taking leave near the end of term.
  • OFLA will no longer provide additional sick child leave for employees who take 12 weeks of parental leave.
  • The OFLA time-off required to be counted in the “look forward” method starting a period of 52 consecutive weeks beginning the Sunday immediately preceding the first date of leave.
