The Illinois Military Family Leave Law requires that employers with at least 15 employees provide eligible employees up to 15 days of unpaid leave, in order to spend time with a child or spouse while their federal or state deployment orders are in effect. Employers with at least 50 employees must provide up to 30 days for the same purpose. The Illinois Domestic Violence Leave Law also applies to employers with more than 50 employees and allows eligible employees who are or have a family or household member who are victims of domestic or sexual violence, to take up to 12 weeks of leave in a 12 month period. The law states that its intention is not to create rights beyond those stipulated by federal FMLA in Illinois.
