FMLA in Illinois requires that any company employing fifty or more, must comply with federal FMLA regulations. Recent news reports indicate that the dollar amounts of fines and judgments for FMLA non-compliance continue to increase. Further, that the Department of Labor intends to increase its annual number of audits and investigations, substantially. These are all clear indications that compliance with FMLA in Illinois is becoming increasingly important and potentially expensive.

In addition to federal FMLA in Illinois, the state also has three other applicable family leave laws. The Illinois Military Family Leave Law requires that employers with at least 15 employees provide eligible employees up to 15 days of unpaid leave, in order to spend time with a child or spouse while their federal or state deployment orders are in effect. Employers with at least 50 employees must provide up to 30 days for the same purpose. The Illinois Domestic Violence Leave Law also applies to employers with more than 50 employees and allows eligible employees who are or have a family or household member who are victims of domestic or sexual violence, to take up to 12 weeks of leave in a 12 month period. The law states that its intention is not to create rights beyond those stipulated by federal FMLA in Illinois.

FMLA in Illinois is also supplemented by the Illinois Small Necessities Law which states that employers with 50 or more employees must also provide eligible employees up to 8 hours of unpaid leave in any school year, with no more than four hours taken in one day, to attend classroom activities or conferences if they cannot be scheduled outside of work hours.
